Litauens parlament har (igen) röstat för homofientlig lag.

I fredags röstade parlamentet i Litauen för ett förslag om att "förbjuda offentligt uppmuntrande av homosexuella relationer". Tydligen var det många som hade svårt att hantera omröstningen, eller kanske det har spridits hemska förkylningar bland politikerna, eftersom 81 av 14o ledamöter var frånvarande.

Av de som verkligen var där röstade 31 ja, 7 nej och 21 avstod. Men för att lagförslaget ska bli verklighet krävs det en ny omröstning vilken planeras 16 december. Det är alltså möjlighet ännu att stoppa det homofientliga förslaget.

Utvecklingen är mycket bekymmersam när det gäller HBT-rättigheter i Litauen. Det som är positivt är att den liberala gruppen i EU-parlamentet nu reagerat och skickat ett officiellt brev till EU-kommissionären Viviane Reding om den oacceptabla situationen i Litauen.
Dear Commissioner,

we know you are due to visit Lithuania this week and we would like to raise with you the request to enquiry with the Lithuanian authorities - and express EU firm opposition, shall media releases be confirmed - on the draft amendments violating freedom of expression and constituting a discrimination based on sexual orientation.

The Lithuanian Parliament voted on Friday 12 November 2010 (with 31 votes in favour, 7 against, with the remaining lawmakers in the 141-seat parliament abstaining or not voting) to proceed with legislation amending the Administrative Code to establish a new offence punishable by a fine (from 2,000 to 10,000 Litas; 580-2,900 Euros) for the "public promotion of homosexual relations".

Such law might be applied to impede equality and gay pride marches and freedom of expression, such as campaigning for LGBT rights (as illustrated by its initiator, MP Grazulis, who during the 2010 Baltic Pride tried to break through the police fences, was set to be prosecuted for this, but the Seimas voted against stripping his immunity). The draft law is intended to implement the "Law of the Protection of Minors Against Detrimental Public Information" adopted last summer, and will undergo second reading on December 16.

As you will recall the European Parliament - as well as the Commission - harshly criticised the Law. The Lithuanian authorities decided to modify it in a way to neutralise it in practice, but here we are now with fines to make it effective.

We are sure that you will agree with us that this amendment is not compatible with European values as enshrined in the ECHR and the Charter of Fundamental Rights and that Lithuanian authorities should not adopt it. We consequently ask you to follow this up with the Lithuanian authorities and inform the EP as soon as possible on the situation in Lithuania in relation to this law.
Avsändarna till brevet är Guy Verhofstadt, ordförande i den liberala gruppen, och några andra ledamöter i EU-parlamentet, bland dem Leonidas Donskis från Litauen och Cecilia Wikström från Sverige.

ILGA-Europa (motsvarigheten till RFSL på Europanivå) publicerar på sin hemsida ett pressmeddelande från föreningen Tolerant Youth Association i Litauen. Föreningen protesterar tydligt emot det homofientliga lagförslaget och skriver i ett pressmeddelande från igår bl.a. följande.
On 12 November the Lithuanian Parliament voted in favour of a proposal by Petras Gražulis, a member of the „Order and Justice“ parliamentary fraction, to make “promotion” of homosexuality an offence punishable by fine of 2,000 to 10,000 litas.

“The essence of my proposal is to ban public promotion of homosexual relations. I think, it would solve many problems, there would be no more permits for various gay parades, no tensions for the society and we, members of Seimas, wouldn’t need to climb over fences fighting against social perversions,” Mr Grazulis was saying to the Parliament.

The parliamentarian was referring to the infamous incident during the “Baltic Pride” march in May, when Mr Grazulis and another MP Kazimieras Uoka tried to break through the police fences. The two were to be prosecuted, but the Parliament voted against stripping them of their legal immunity.

This is not the first case of legislations tampering with the rights of homosexual people. In June, the Parliament passed a notorious Law of the Protection of Minors Against Negative Public Information. Originally, it contained a provision explicitly banning any information on homosexuality and only after huge international pressure was the law slightly modified.

Before the final vote in the Parliament, the bill will be debated in the Committee on Legal Affairs and the Committee on Human Rights.

“Once again, the Lithuanian parliamentarians are demonstrating their complete disregard for human rights and the values of democracy. It’s yet another sign of the new round of homophobic legislations that might be coming,” said Artūras Rudomanskis, chairman of a Lithuanian NGO, the Tolerant Youth Association.
De 7 parlamentsledamöter i Litauen som röstade emot det homofientliga förslaget är från liberala LSF och socialdemokratiska LSDPF. Men inte ens de var eniga. Faktum är nästan hälften av de närvarande socialdemokratiska politikerna, bland dem deras ordförande, röstade för "förbudet mot att offentligt uppmuntra homosexuella relationer" och folk från båda partierna avstod vid omröstningen.

Mittenpartiet DP röstade enigt för det homofoba förslaget. De är med i samma grupp i EU-parlamentet som Folkpartiet och Centerpartiet. Det är också LSF som röstade homovänligast om än inte enigt. LSDPF är med i samma grupp i EU-parlamentet som Socialdemokraterna.

Från TSLKDF, som är ett kristdemokratiskt högerparti, avstod de flesta medan några röstade ja. Det är landets största parti och har statsministerposten. De är med i samma grupp i EU-parlamentet som Moderaterna och Kristdemokraterna.

Det parti i landet som är tydligast homofientligt, även om det som vi kan konstatera är en viss konkurrens om det, är högerpartiet TTF som varit drivande för förslaget. De är med i den "nationalistiska" gruppen i EU-parlamentet.
