Påven försöker stoppa HBT-vänlig resolution i Europarådet.

Europarådets parlament hade kunnat säga ja till en tydlig HBT-vänlig resolution i januari i år. Men bl.a. påven och kristna samfund i Ryssland och Ukraina har lobbat för att försöka stoppa resolutionen eller i alla fall göra den mindre tydlig. Ledamöter i Europarådets parlament har lämnat 80 tilläggsförslag, 70 av dem i syfte att göra resolutionen mindre positiv för HBT-personer. Eftersom man hade problem att hinna med alla ärenden i januari beslöt man till sist att rösta om resolutionen vid sitt nästa möte i april i år.

För er som inte känner till Europarådet är det en organisation som samlar nästan alla demokratier i Europa. Vitryssland får inte vara med eftersom det är en diktatur. Även andra länder har demokratiska brister t.ex. Ryssland men föreningen har resonerat att det är bättre att påverka den typen av länder inom rådet, vilket nog är klokt.

Det var Europarådets Committee on Legal Affairs and Human Rights som 8 december 2009 sa ja till resolutionen Discrimination on the basis of sexual orientation and gender identity. Främste ansvarige för HBT-rapporten är "rapportören" Andreas Gross som är från Schweiz och är med i den socialistiska gruppen i Europarådets parlament.

Förslaget till HBT-resolution innehåller bl.a. följande rekommendationer till alla medlemsländer i Europarådet.
ensure that the fundamental rights of LGBT people, including freedom of expression and freedom of assembly and association, are respected, in line with international human rights standards;

provide legal remedies to victims and put an end to impunity for those who violate fundamental rights of LGBT people, in particular their right to life and security;

condemn hate speech and discriminatory statements and effectively protect LGBT persons from such statements;

adopt and implement anti-discrimination legislation which includes sexual orientation and gender identity among the prohibited grounds for discrimination, as well as sanctions for infringements;....

ensure legal recognition of same-sex partnerships, as already recommended by the Assembly in 2000, by providing for:

the same pecuniary rights and obligations as those pertaining to different-sex couples;

"next of kin" status;

measures to ensure that, where one partner in a same-sex relationship is foreign, this partner is accorded the same residence rights as would apply if she or he were in a heterosexual relationship;

recognition of provisions with similar effects adopted by other member states;

provide the possibility for joint parental responsibility of each partner’s children, if not also the right of each partner to adopt the other partner’s children;

ensure that laws relating to the adoption of unrelated children by single persons are applied without distinctions based on sexual orientation, in accordance with the 2008 E.B. v. France judgment of the European Court of Human Rights;

address the specific discrimination and human rights violations faced by transgender persons and, in particular, ensure in legislation and in practice their right to:

safety;

documents that reflect an individual’s preferred gender identity, without any prior obligation to undergo sterilisation;

access to gender reassignment treatment and equal treatment in health care areas;

equal access to work, goods, services, housing and other facilities, without prejudice;

relationship recognition and the right to found a family, in accordance with the case law of the European Court of Human Rights;....

encourage dialogue between national human rights institutions, equality bodies, human rights defenders working on the rights of LGBT persons and religious institutions, based on mutual respect, in order to facilitate public debates and reforms on issues concerning LGBT persons;

recognise persecution of LGBT persons as a ground for granting asylum and implement the 2008 Guidance Note on refugee claims relating to sexual orientation and gender identity of the Office of the United Nations High Commissioner for Refugees.
De flesta rekommendationerna är väl egentligen ganska givna om man är för mänskliga rättigheter. Men det är intressant att notera att ett land som Sverige inte följer alla av dem ännu, här är det i könstillhörighetslagen ännu krav på sterilitet för att "byta kön" vilket kritiseras i HBT-resolutionen.

Även om det det alltså inte blev någon omröstning i Europarådets parlament i januari så hade man tid för viss debatt. Glädjande nog var 17 av 19 talare entydigt positiva till HBT-resolutionen och många av dem argumenterade retoriskt väl. Vill du följa debatten så är även den med på Europarådets hemsida.

Extra intressant var att den konservativa gruppen (där bl.a. m och kd är med) sa ja till den HBT-vänliga resolutionen. Det var Elvira Kovacs från Serbien som argumenterade för den konservativa gruppen i debatten. Hon sa då bl.a. följande.
Our common goal must be to combat all kinds of discrimination and particularly discrimination on grounds of sexual orientation and gender identity, in order to ensure respect for the human rights of lesbian, gay, bisexual and transgender – LGBT – persons, especially their right to life and security so that they can live in dignity. They must not be stigmatised and victimised either in the public or the private sphere. We should therefore develop awareness-raising programmes, fostering an understanding of LGBT people, particularly when it comes to public officials, the media and so forth. Everyone, despite his or her sexual orientation or gender identity must have equal access to work, goods, services, housing and other facilities.

As I have already mentioned, stereotyping is still prevalent among large segments of the whole community. This restricts LGBT people’s enjoyment of their fundamental rights. Change in the role of men as well as women in society is needed to achieve their full freedom.

Så sent som för några år sedan hade det nog varit omöjligt att den konservativa gruppen i Europarådets parlament skulle argumentera tydligt för HBT-rättigheter och emot könsroller men det avslöjar hur snabb utvecklingen varit i Europa de senaste åren, även om det givetvis ännu är många problem kvar.

ILGA-Europa (motsvarigheten till RFSL på Europnivå) gläds också åt det betydande stödet för HBT-resolutionen i debatten men varnar också för att det är risk för att många tilläggsförslag får majoritet vid omröstningarna i april i Europarådets parlament.

But there are grounds for thinking that, when it does come to voting, things will be much more evenly balanced.

Of the amendments, 70 seek to weaken the resolution. Some of these were considered by the Legal Affairs and Human Rights Committee, and two found majority support in the committee.

The hostile amendments were tabled mainly by delegates from two countries – Italy and the Russian Federation.

Some of the issues which they put forward were:

Giving priority to freedom of religion over the right to private life and non-discrimination;

Challenging any language which might be seen as restricting the freedom of faith organisations and individuals to use speech inciting intolerance;

Removing explicit support for legal recognition of same sex partnerships, and eliminating references to family rights or adoption.

Weakening support for state funding for gender reassignment treatment.

Protecting “religious freedom” (i.e. the right to discriminate) in employment, services provision and education.

The Holy See issued "guidance" to some members of the Assembly in support of hostile amendments. One speaker described this as "scandalous".

Det är återigen avslöjande för påven och katolska kyrkan att de försöker försämra och hindra arbetet för mänskliga rättigheter för homosexuella, bisexuella och transpersoner.


Uppdatering 1

Påven mötte för övrigt katolska biskopar från Norden i fredags. Han ska då enligt en artikel i tidningen Dagen kommenterat situationen i bl.a. Sverige.
Påminnelsen om familjens centrala roll i ett sunt samhällsliv är ett av de viktigaste budskapen i de nordiska länderna, sa påven och konstaterade vidare att han de senaste åren kunde se en försvagning av "äktenskapsinstitutionen och den kristna förståelsen av människans sexualitet"
Kommentaren är något besynnerlig. Sverige och Norge har ju tvärtom de senaste åren gjort det möjligt för fler par att ingå äktenskap, även samkönade par. Men det är väl det där med "människans sexualitet" påven har problem med. Det hade kanske varit bättre om han de senaste åren jobbat emot pedofilskandaler inom det egna samfundet istället för att ägna sig åt kampanjer emot äktenskap för vuxna människor som älskar varann.

Dagen Nyheter avslöjar idag att ännu fler katolska präster ägnat sig åt sexuella övergrepp på barn. Ofta har katolska kyrkan försökt få barnen att tiga och skyddat förövarna. Det är givetvis helt vidrigt.
